Major Sewer Project down Via Marina Planned

A City of Los Angeles sewer project is planned to go through the heart of Marina del Rey along Via Marina from Marquesas Way all the way down to the channel. The County is planning on shutting down all but one or two traffic lanes on Via Marina beginning in August 2010 for a period of 12-18 months. The project schedule calls for work to be carried out Monday through Saturday from 7:00AM to 9:00PM.

There is an alternative to this project and that is to lay the new sewer pipe under the beach.  This would cause no disruption to the residents nor traffic. Another option is to lay the sewer pipes along Pacifc Avenue but homeowners raised enough concern that the Department of Public Works chose Via Marina as the ideal route. Why? Because we are in the County of Los Angeles, not the City, which has no regard for our community.

The draft Environmental Impact Report was approved in June, allowing work from 7:00a.m. to 9 p.m. daily and on Saturdays! The EIR did not take into account additional construction here. Many more projects have been approved by the County of L.A., including a nineteen story hotel on Via Marina and much larger, new apartment complexes in place of Del Rey Shores. Bar Harbor and Neptune apartments.

1.     Noise, pollution, vibrations, air quality, mature trees lost           
2.     Length of operations: 12-18 months
3.     Hours of operation: 7-9 weekdays; 7-6 Saturdays
4.     Some two thousand residents of Via Marina, boaters and restaurants will be subjected to years of apartment and hotel development as well as to the sewer project.
5.     There is methane gas under the street. The project manager said that there would be 24 hour surveillance!
6.     A new BEACH sewer will take less time, use less pipe and be less expensive. There will be less disruption to residents and traffic. Marina Peninsula does not object.
7*.As County residents, we were not informed in time to make public comment on this City project.
8.  Traffic will be reduced to one lane, even on our major North-bound route to the 405 freeway.

The City Engineer may not according to the Brown Act issue a Coastal Development Permit because the Engineer is not a legislative body of the State of California entitled under the Act to take action as action is defined in the Act to approve or disapprove of a CDP.

The City Engineer is operating under a ordinance adopted by the City Council that violates the Brown Act (State Open Meeting Act).

Furthermore the City Engineer is not entitled to create or adopt an EIR on County Land covered by Federal Easements.

All of the above violate Chapter 4 Article 2.5 of the California Coastal Act calling for due process of law and fairness.
